Transport for NSW did not effectively plan and procure the CBD and South East Light Rail (CSELR) project to achieve best value for money according to a report released today by NSW Auditor-General, Margaret Crawford.

Transport for NSW is on track to deliver the project, but it will come at a higher cost with lower benefits than in the approved business case.

Overall, NSW Government initiatives and processes to prevent and reduce red tape were not effective, according to a report released today by the NSW Auditor-General.

In 2015, the Government reported that its red tape reduction initiatives, implemented between 2011 and 2015, had resulted in $896 million in savings. While these initiatives resulted in some savings, the total value of savings is unknown because estimates for some initiatives were based on unverified assumptions, cost transfers or unrealised projections.

Enrolments in quality early childhood education programs in New South Wales are increasing but are below the national benchmark, according to a report released today by the NSW Auditor-General, Margaret Crawford.

Ninety-five per cent of children should be enrolled in at least 600 hours in the year before school, but according to the latest NSW figures 77 per cent of children were enrolled in quality early childhood education programs. This 2015 figure is below the benchmark, but is a significant improvement on 2013 when 59 per cent were enrolled.

We found that the two NSW Health campaigns had followed the required approval processes and were appropriate. We had some concerns with the two Department of Premier and Cabinet (DPC) campaigns. The revised Guidelines, which incorporate recommendations from earlier audit reports, are a positive step towards reducing the risk that publicly funded advertising could be used inappropriately. But there are still parts of the Guidelines that require a subjective judgement and therefore do little to help manage this risk. While we did not have any concerns with the two NSW Health campaigns, the two DPC campaigns highlighted these risks.

This audit focuses on the M4 handback. It looks at whether the road will be in good condition when the State gets it back, and whether it will cope with the extra traffic after the toll is removed. These are critical issues for taxpayers and motorists. Taxpayers don’t want to be responsible for a large repair bill and motorists don’t want to be stuck in traffic jams.

To ensure that future private sector partnerships (PPP) deal adequately with handback, we recommend that the Roads and Traffic Authority (RTA):

• ensure deeds spell out an appropriate inspection and testing program to determine repairs required to bring roads up to a satisfactory condition at handback (p.11)
• ensure deeds link condition standards and maintenance approaches to changing industry standards and approaches over the life of the PPP (p.11)
• consider including in deeds a requirement that operators provide a performance bond or similar security over the cost of handback repairs (p.11)
• review the lessons learnt from the M4 tollway handback and determine whether it should seek to negotiate changes to existing tollway deeds to better deal with handback, by June 2010 (p.11)

The RTA (Roads and Traffic Authority) approach to detecting and enforcing heavy vehicle safety has produced mixed results. There have been overall decreases in the number of crashes and people killed and injured in crashes involving heavy vehicles between 2002 and 2007. However, the number of crashes and the number of people injured have increased between 2006 and 2007.

We recognise that the RTA is unable to prevent all crashes. However, we consider that the RTA could do more to improve its ability to detect and respond to high risk heavy vehicles travelling on our roads.

The Audit Office is of the opinion that the basis for environmental impact assessment of major projects in NSW is sound. The key concept of 'environmental significance' is well defined. The system is closely specified. The Department of Urban Affairs and Planning (DUAP) leads a whole-of-government approach to environmental impact assessment and its assessments are comprehensive. However, the Audit Office considers that there are opportunities for improvement by more actively managing the participants and the performance of the environmental impact assessment system. DUAP needs to strengthen its internal documentation and must ensure the public have greater involvement.

The regulatory framework introduced under the Protection of the Environment Operations Act 1997, along with other initiatives progressively being implemented by the Environment Protection Authority (EPA), should enhance the overall effectiveness of environment protection in NSW. The Audit Office is of the opinion that the framework is consistent with best practice and once fully implemented, should contribute to the achievement of further improvements in the environmental performance of industry.

However while the legislative framework supports best practice in regulation and enforcement, there are a number of issues which limit the effectiveness of the reforms. Some of the problems, such as the quality of licences and the effectiveness of compliance activities, have been identified by the EPA and may be addressed through recent initiatives.

The Audit Office is of the opinion that the RTA is taking positive steps in planning for road maintenance and in many instances follows better practice. There are, however, some important improvements which need to be implemented in order to enhance the efficiency and effectiveness of that function.

The Audit Office is of the opinion that the arrangements for the enforcement of parking are not as efficient and effective as they could be and should be reviewed. Accountability of the enforcement role needs to be improved. Currently there is minimal monitoring of the success or otherwise of the enforcement function.

There is a need to address and assign more closely the current responsibilities for enforcement arrangements between the Police Service and councils. There is also a need to articulate more clearly the objectives to be achieved from the legislation and their relative priorities.
