The distributions to the NSW Government increased from $690 million in 2013-14 to $1.0 billion in 2014-15. The increase was largely due to a higher dividend from Sydney Water Corporation.

The NSW Environment Protection Authority has reduced the average time to assess contaminated sites from 203 days in 2013-14 to 73 days in 2014-15. It is also improving transparency by making more information on its performance publicly available.
 
In 2014-15, the Department of Planning and Environment increased new housing approvals across New South Wales by 12 per cent to 58,252, exceeding the State priority target of 50,000. It also reduced the time taken to assess major projects from about three years in 2013-14 to four months in 2014-15.

Volume Five 2015 covered Premier and Cabinet agencies such as the Department of Premier and Cabinet, Office of Sport, Venues NSW, Barangaroo Delivery Authority and Infrastructure NSW.

The Government Advertising Act 2011 requires the Auditor-General to conduct an annual performance audit to check NSW Government agency compliance with the Act.

This audit focused on the Department of Premier and Cabinet’s (DPC) role in monitoring government agencies compliance with government advertising requirements, and examined advertising campaigns run by Destination NSW and the Sydney Opera House.

The independent assurance given to the NSW Government and sponsor agencies on the viability of large capital projects throughout their lifecycle is inadequate. Government policy is regularly not followed and not properly communicated to those responsible for implementing such policy.
 
This audit sought to test the effectiveness of the NSW capital project assurance system - which includes gateway reviews and reporting - but significant levels of non-compliance identified in our case studies prevented this. The NSW Commission of Audit also identified this issue in 2012. Gateway reviews are conducted by independent reviewers at key stages of a project’s life cycle and provide an independent assessment on a project’s readiness to proceed to the next stage.

The Country Towns Water Supply and Sewerage Program has effectively promoted adoption of better management practices by local water utilities, but will not achieve its objective of eliminating the water supply and sewerage infrastructure backlog in urban areas of country NSW.
 
The $1.2 billion Program aims to help local water utilities provide appropriate, affordable, cost effective and well-managed water supply and sewerage services in the urban areas of country NSW. It has two broad elements:

• promoting adoption of better practices 
• providing financial assistance towards the capital cost of infrastructure backlog works.

The report includes comments on his financial audits of NSW Government environment, climate change and water agencies. The audits of these agencies’ financial reports for the year ended 30 June 2010 resulted in one qualified Independent Auditor’s Report. Sydney Water has not recognised assets and liabilities of the Build-Own-Operate schemes in their statement of financial position. The combined profit after tax of the four largest water utilities increased substantially from $300 million in 2008-09 to $584 million in 2009-10. Distributions to the Government were $379 million up 17 per cent or $55 million from last year.

The department has a systematic approach to receiving, investigating and responding to reports of pollution incidents. However, the department does not analyse and report on the extent of environmental harm caused by pollution incidents reported to it, whether its response has minimised harm to the environment, whether its regulatory approach has improved compliance, particularly by Environment Protection Licence (EPL) holders (licensees).

In our opinion the Government’s ‘no net cost to government’ requirement was a legitimate (but not the only possible) basis for the tunnel bid process. The Government was entitled to decide that tunnel users meet the tunnel costs. Structuring the bid process on the basis of an upfront reimbursement of costs incurred (or to be incurred) by the Roads and Traffic Authority (RTA) was therefore appropriate.

In our opinion, however, the Government, Treasury and the RTA did not sufficiently consider the implications of an upfront payment involving more than simple project cost reimbursement (i.e. the ‘Business Consideration Fee’ component). In addition, the RTA was wrong to change the toll escalation factor late in 2002 to compensate the tunnel operator, Cross City Motorway Pty Ltd, for additional costs.
