Many factors are contributing to the overcrowding of the NSW prison system. This is in turn putting pressure on operations in the courts, and could ultimately impact rates of reoffending.

The lack of capacity is impacting more than just the NSW prison system. Over the weekend of 31 October 2015 some inmates held by the NSW Police Force could not be brought before a court because of capacity shortages.

This was one of the findings reported in Volume Seven 2015 of the Auditor-General’s Report to Parliament, which covers law and order services provided by the NSW Police Force, Department of Justice, and NSW Trustee and Guardian.

Demand for emergency services increased by eight per cent, in response to 187,282 incidents during 2014-15. Total volunteer numbers have risen over the last three years by 2.4 per cent to 98,536, improving capacity to deal with such incidents. NSW Rural Fire Service had only five emergency declarations in 2014-15 compared to 48 the year before, resulting in natural disaster expenditure falling by $89.0 million.
 
Fire and Rescue NSW response time to incidents and NSW Rural Fire Service fire containment continue to improve.
 
These are some of the matters highlighted in Part 2 of Volume Seven 2015 of the Auditor-General’s Report to Parliament, which covers emergency services agencies.

Public transport revenue decreased by 2.7 per cent despite a fare increase and increased patronage. Twenty-five per cent of all Opal trips (over 74 million) were free, including 47 per cent of trips on ferries, according to a report released today by the New South Wales Acting Auditor-General, Tony Whitfield. These trips were valued at $189 million.

The 2014 audits showed that the quality and timeliness of financial reporting have continued to improve. However, many agencies do not have financial sustainability indicators that provide early warning of management issues, such as an inability to meet financial obligations. Weaknesses were identified in information security, management of leave balances, asset management and internal controls.
 
Governance issues and gaps in performance information and reporting across the sector suggest Chief Financial Officers should have a stronger role and be more involved in strategy and risk management to maximise performance and add value.

Roads and Maritime Services and Transport for NSW have deployed many controls to protect traffic management systems but these would have been only partially effective in detecting and preventing incidents and unlikely to support a timely response. There was a potential for unauthorised access to sensitive information and systems that could have disrupted traffic.
 
Until Roads and Maritime Services’ IT disaster recovery site is fully commissioned, a disaster involving the main data centre is likely to lead to higher congestion in the short-term as traffic controllers would be operating on a regional basis without the benefit of the Traffic Management Centre.

In our opinion the Government’s ‘no net cost to government’ requirement was a legitimate (but not the only possible) basis for the tunnel bid process. The Government was entitled to decide that tunnel users meet the tunnel costs. Structuring the bid process on the basis of an upfront reimbursement of costs incurred (or to be incurred) by the Roads and Traffic Authority (RTA) was therefore appropriate.

In our opinion, however, the Government, Treasury and the RTA did not sufficiently consider the implications of an upfront payment involving more than simple project cost reimbursement (i.e. the ‘Business Consideration Fee’ component). In addition, the RTA was wrong to change the toll escalation factor late in 2002 to compensate the tunnel operator, Cross City Motorway Pty Ltd, for additional costs.

In recent years the department has significantly changed its approach to rehabilitating prisoners. It has introduced programs to address offending behaviour based on evidence of what works. It has also formed partnerships with other agencies to help reintegrate prisoners into the community. We believe the department is on the right path and should continue building on these initiatives.

Despite these efforts, almost one in two prisoners return to prison or community supervision within two years of release, which is similar to other states. Most of these return to prison. In our opinion there is a risk that the department releases prisoners who have not addressed their rehabilitation needs. The department appears to address immediate health and welfare concerns. But it does not formally assess the education and work needs of all prisoners.

The Audit Office is of the opinion that, while agencies are aware of the need to manage risk, their risk management falls short of better practice. Many agencies do not consider their risk management to be adequate. The survey suggests that some agencies, mainly those in the Public Trading Enterprise Sector have approached risk management in a systematic way and in accordance with the principles of better practice standards. Others, mainly departments not subject to commercial imperatives, have yet to progress the management of risk beyond the traditional response of insuring against the more common types of risk. Thus there is a danger that with a number of agencies, risk may not be managed adequately, especially in the General Government Sector.
