We issued unqualified audit opinions on the transport entities’ 30 June 2012 financial statements.

Some of the findings of the report include:

  • government funding to the public transport operators totalled $4.4 billion in 2011-12 ($3.7 billion in 2010-11)

  • passenger services revenue only covered 20 per cent of RailCorp's operating costs

  • Transport for NSW has formalised a protocol to mitigate the risk of potential conflicts of interests

  • At present, no sustainability framework exists for the transport agencies around environment and sustainability. Transport for NSW should complete its Environment and Sustainability Policy Framework by June 2013 and should publicly report its results annually

  • Transport patronage continued to grow with 510 million journeys on train, bus and ferry services

  • CityRail had two peak hour periods where only 36 per cent and 39 per cent of services were on time

  • On-time running performance for Sydney Ferries was above the NSW 2021 plan target of 98.5 per cent for most routes in 2011-12

  • Customer surveys by transport agencies no longer specifically address crowding on public transport. Transport for NSW should observe and report on crowding on all transport modes

  • Over 2,500 transport staff, or 8.3 per cent of the workforce, have excessive leave balances. All transport entities should do more to reduce excessive annual leave balances to ensure they will comply with new targets set by the Premier.

The NSW Government’s defined benefit superannuation funds have had positive returns for the last three years. However, the returns fell significantly in 2011-12. Global economic conditions led to substantial volatility and uncertainty in markets creating challenges for superannuation funds’ trustees.

Neither agency (NSW Ministry of Health and NSW Police Force) demonstrated that they continued to get value for money over the life of these long term contracts or that they had effectively managed all critical elements of the three contracts we reviewed post award. This is because both agencies treated contract extensions or renewals as simply continuing previous contractual arrangements, rather than as establishing a new contract and financial commitment. Consequently, there was not a robust analysis of the continuing need for the mix and quantity of services being provided or an assessment of value for money in terms of the prices being paid.

Since our performance audit in 1995 the government has improved guidance for agencies and introduced a more robust framework for approving advertising campaigns. Greater rigour has been introduced into the process by requiring campaigns to be peer reviewed and approved by Cabinet. This new approach aims to improve the effectiveness and value for money of government advertising. We found however that the current guidelines are not adequate to prevent the use of public funds for party political purposes. We also found it difficult to obtain information on the total amount spent on advertising campaigns. This is because there is no central record of the total expenditure, only the cost of placing advertisements in the media. Greater transparency around what is spent would support more accurate and informed debate.

Between 2004 and 2006, the number of signalling failures, signalling downtime and the number of trains delayed as a result of signal failures all fell. RailCorp’s on-time running performance improved over the same period. The fall in failures is a clear indication of improved performance. Changes in the definition of on-time and to the timetable during 2005 and 2006 however make it difficult to determine whether improvements in response downtime and signalling delays are due to a true performance improvement. To build upon this strong base, RailCorp needs to determine with more confidence the number and duration of signalling failures the network can tolerate without impacting on service levels.

We see considerable potential for the Ministry of Transport to plan and manage interchanges more effectively, so as to make better use of our public transport network. We believe that the Ministry now needs to focus more on multi-modal transport planning and interchange performance. It needs to assign responsibility for the coordination and oversight of inter-modal operations to an entity resourced for the purpose. Without this it will continue to be very difficult to identify and address unmet needs, seek and secure stakeholder funding, and monitor and evaluate system performance.

The Audit Office is of the opinion that, while agencies are aware of the need to manage risk, their risk management falls short of better practice. Many agencies do not consider their risk management to be adequate. The survey suggests that some agencies, mainly those in the Public Trading Enterprise Sector have approached risk management in a systematic way and in accordance with the principles of better practice standards. Others, mainly departments not subject to commercial imperatives, have yet to progress the management of risk beyond the traditional response of insuring against the more common types of risk. Thus there is a danger that with a number of agencies, risk may not be managed adequately, especially in the General Government Sector.

State Transit has developed fleet management plans and maintenance standards that meet its regulatory and contractual obligations as a bus operator and are consistent with vehicle manufacturers’ standards and best practice. However, assumptions used in fleet management plans to forecast fleet growth may not result in the most efficient and effective outcome for State Transit. Forecasts fail to take account of opportunities to redesign or reduce services where they exceed contract requirements and are difficult to justify on a commercial basis. Of greater concern are the consequences arising from bus maintenance practices not meeting State Transit’s own standards.

Despite the issue being on the agenda for many years (formally, at least since 1988), at present there is not a comprehensive record of all government property assets in NSW. Whilst initiatives currently underway are promising, they will require continued priority to achieve tangible results. And careful coordination will be required to avoid duplication and waste.

The Audit Office has undertaken an audit on Government Office Accommodation. The audit examined the cost effectiveness of long-term leasing versus ownership and the housing of agencies involved with the delivery of core government activities.  Core activities are those intrinsically linked to basic and ongoing functions of Government and Parliament.

It recommends that:

  • the Government consider owning office accommodation, as opposed to leasing, for its long-term core needs, subject to a case by case analysis of the relevant financial and nonfinancial factors

  • the Government undertake an analysis of the costs/savings from proposed asset sales of office accommodation in light of the demonstrated need for long-term office accommodation (for core needs) New, Expired and Expiring Leases

  • given the findings of the own versus lease case studies presented in this report, it is recommended that the Government require agencies to undertake, in collaboration with the Department of Public Works and Services (DPWS) a cost/benefit analysis of available accommodation options prior to committing to any proposed major new leases

  • the Government direct the DPWS, in collaboration with all agencies, to negotiate the renewal of all major expired/expiring leases (where continued occupancy is warranted) in order to reduce the financial risk of above-market rent increases and the risk of cancellation of leases (Major leases are defined, for the purposes of these recommendations, to be those over $500,000 rental per annum or a net lettable area over 1,000 square metres) Management of Property Information

  •  in order to improve the integrity of the Government Office Accommodation Database, agencies be required to respond to the annual data request from DPWS by a predetermined date

  • a senior officer within each agency be required to certify to the accuracy of information provided by an agency as input to the database maintained by DPWS

  • DPWS verify, on a sample basis, information provided by agencies as input to the Government Office Accommodation Database Premier’s Memorandum No 97-2

  • the compliance by agencies with Premier’s Memorandum No 97-2 Government Office Accommodation and Property Disposal be established by DPWS.
