The regulatory framework introduced under the Protection of the Environment Operations Act 1997, along with other initiatives progressively being implemented by the Environment Protection Authority (EPA), should enhance the overall effectiveness of environment protection in NSW. The Audit Office is of the opinion that the framework is consistent with best practice and once fully implemented, should contribute to the achievement of further improvements in the environmental performance of industry.

However while the legislative framework supports best practice in regulation and enforcement, there are a number of issues which limit the effectiveness of the reforms. Some of the problems, such as the quality of licences and the effectiveness of compliance activities, have been identified by the EPA and may be addressed through recent initiatives.

This performance audit indicates that the Service has considerable work to do to reach its aspirations of being recognised amongst leading examples of best practice services. The commitment of the Service to serving the community and the professionalism of the Service's officers is not in question. It is, however, apparent that a number of barriers to performance will need to be overcome for the Service to perform as well as it would wish.

The Audit Office recognises that TAFE NSW has undergone significant change in the last decade in order to improve service delivery. Whilst the focus of change has been TAFE NSW's core educational role, administration has also benefited. The Quality Management Systems introduced by the Institutes are an example.

The Audit Office is of the opinion that TAFE NSW needs a means by which the efficiency and effectiveness of administrative functions can be assessed notwithstanding initiatives by certain Institutes to introduce monitoring, benchmarking and reporting of administration. In the interests of accountability, TAFE NSW requires the establishment of a common performance reporting framework for administration in each Institute and across Institutes. Along with other key result areas of TAFE NSW’s operations, a reporting framework would better able the TAFE Commission Board (the Board) to inform the Minister for Education, in compliance with the Act, of the efficiency and effectiveness of the administrative functions.

Realisation of the Government’s objectives for integrating computers into the school environment is a major change that will take some time to achieve. The logistics of equipping schools with computers and making them operational have been approached energetically by the Department. Four years into the Computers in Schools Program, student and teacher access to computer hardware, software and the Internet is now substantially greater and teachers are now better placed to integrate computers into teaching and learning. But while much has been achieved there are significant challenges that still remain.

The Audit Office is of the opinion that the RTA is taking positive steps in planning for road maintenance and in many instances follows better practice. The Audit Office is of the opinion that cost of administration at the University of Western Sydney is unnecessarily high and could be reduced. In addition, its approach to administration can place barriers in the way of potential students and other users of the University. To its credit, the University has recognised that administrative costs are high and is developing plans to reduce those costs. The Audit Office considers that there is now an urgent need to accelerate those activities and to move from planning to implementation. Further delays will be costly and will affect the service the University provides to its customers, the students and other users.

The Audit Office is of the view that the intention to achieve greater accountability for, and transparency in, public school performance is highly commendable. To date, these provisions have not been imposed by the Government on private schools even where public funds are provided to such schools.

The model however has fallen short of its potential because the reporting protocols allow principals and self-evaluation committees the scope to determine what, in their view, is ‘significant’ for their school and how they will report on it. Although the Department has set out a common reporting format to be used, and schools have been given specific directions on what information should be reported, in the reports reviewed by The Audit Office it was apparent that the definition of ‘significant’ and the clarity of reporting varied between schools.

The Olympic Coordination Authority (OCA) has made a concerted and commendable effort in preparing the Games Budget within the definition of expenditure for the Games approved by the Government. OCA has also effectively used the definition of cost to control claims made by government agencies against the estimates to host the Games.

However, because the Games Budget was prepared in accordance with that definition, the Games Budget arguably does not capture the overall expenditure associated with the Games, as required by the Olympic Co-Ordination Authority Act. Accordingly, the taxpayers of NSW do not have a complete picture of the costs for hosting the Games.

The Audit Office is of the opinion that:

  • the sale was delivered with reasonable efficiency and effectiveness

  • the sale yielded a satisfactory return to the NSW Government. The possibility for a higher return was limited to about 2% to 4% on gross proceeds of $936m. It would have required setting a higher share price for all investors and adopting a more flexible approach to share allocation

  • the Government’s objective to promote community and investor support was achieved. The scale of the demand for script added to costs and was not fully translated into higher proceeds  

  • generally satisfactory accountability frameworks were put in place for the sale and no probity concerns were identified

  • the frameworks to achieve the Government’s wider reforms of the racing and wagering industries have substantially been implemented.

Guidelines for staff are available for each of the three schemes, but they do not yet provide staff with sufficient information on how to attract proposals, undertake assessments, negotiate agreements and monitor assistance. Some training of staff responsible for assessing proposals, negotiating agreements and monitoring outcomes has been provided, but needs to be enhanced. In particular, The Audit Office believes that there is insufficient guidance for staff in undertaking economic assessment of proposals. 

There is a prevailing view amongst Department of State and Regional Development staff that guidelines are just that, and need not be followed. It was apparent, however, that assumptions made in assessments were not always appropriate and may lead to poor decisions. Flexibility need not be impaired by requiring greater adherence to guidelines. This would help ensure minimum standards of process and rigour in all cases.
